As an example of why experience makes a difference, KJC Law Firm represented a man who was found with a handgun in his motor home. He was not from Massachusetts, and he did have a license to have a gun in his home state. In Massachusetts, however, that often makes very little or no difference whatsoever: he had no license to carry a gun in Massachusetts, and the gun was discovered while the motor home was being searched in connection with an investigation for domestic violence. The defendant was a veteran, former police officer, and former corrections officer. The only offer from the Commonwealth for a plea was eighteen months in jail. The defendant would have lost his federal pension and state pension benefits. He hired two very well-known attorneys from a large city in Massachusetts, and both of those attorneys advised him to plead guilty to avoid stiffer penalties. Luckily, he did not give up and neither did KJC Law Firm. Through vigorous investigation, we were able to determine that the client may have qualified for a little-known exemption and obtain a landmark ruling in which the trial court allowed argument to the jury that certain aspects of his life made him exempt from the gun laws. At the conclusion of the trial, the jury deliberated for less than thirty minutes before finding him not guilty. Similarly, Attorney Ben Duggan has tried numerous gun cases in state and federal court. Most recently, Ben was able to secure an acquittal at trial for his client who was facing a 15-year minimum-mandatory state prison sentence on a gun charge.
