Our client was a female surgeon who was denied hospital privileges for no apparent reason. Some years before, she had been discriminated against by her male supervisors at a hospital where she worked. She thought the second hospital had spoken to her former supervisors, but she had no proof of what had gone on in the confidential meeting.
We knew that we had little chance of getting the information we needed if we sued in state court because the discussions by doctors at these sorts of meetings are considered to be “peer review” and privileged by statute.
We took an alternate route and filed the case in federal court under a federal discrimination statute. There we had an argument that the state peer-review statute did not apply and that there was no similar federal privilege.
The defendants tried to get our case dismissed. As a result of a significant court battle, we were able to get the information and documents that the defendants claimed to be peer-review privileged. That gave us the evidence we needed from the confidential meetings to move the case forward.
We were contacted by the lead trial lawyer in a case on the west coast that involved death and severe injuries as a result of a helicopter crash. He had won a hard-fought judgment of $69.7 million.
During the pendency of that case, the insurance company responsible for paying certain benefits had interfered with their efforts to prosecute the case in a way we thought was illegal.
The problem was that the Massachusetts 3-year statute of limitations had passed on some of our claims by the time we got the case.
We sued the insurance company in Massachusetts on claims with longer statutes of limitation and included the other claims, but their lawyers got some of our best claims dismissed. We looked at every other possible state that arguably might have jurisdiction over the case to see what we could do.
We figured out a way to bring another lawsuit on those dismissed claims in Oregon, where the statute of limitations was longer.
Now we were litigating claims in two courts on opposite coasts. The insurance company knew we were not going away. After years of legal skirmishes, the case settled.
