But in the days following your auto accident, a representative from your insurance company or the other driver’s insurance company will likely give you a call to take a statement, and if you give one, the insurance company may use it against you. Here is a quick primer on what to do immediately following your auto accident to make sure you are not caught off guard and make statements that could hurt your chances for a settlement.

When an insurance company representative calls, and they will likely call within a day or two, tell them that you need some time and to call back in a week. Give them your name, address and phone number, and the name, address, and phone number of your lawyer. Nothing else. They will say they only need to take your statement, and that it will only take a minute, but don’t say anything. If you have not already done so, this will give you time to hire a lawyer who has experience in dealing with this. When they call again, give them the name and phone number of your lawyer only and then politely say goodbye and hang up. If they call back tell them the same thing. Never give a statement to an insurance adjuster or attempt to negotiate a settlement as they will try to settle your case quickly and at the lowest cost.

You also need time to prepare an expert case against the driver that injured you so that you can collect the maximum amount that you are entitled to from the driver’s insurance company as reimbursement for medical expenses and as compensation for pain and suffering.
